ORDER

The Contempt Petition has been filed to punish the contemnor for his wilful disobedience of the order passed by this Court in W.P.(MD)No. 21655 of 2024 dated 12.09.2024.

2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the contemnor would submit that in pursuance of the direction of this Court, the Assistant Commissioner of Police conducted an enquiry and examined all the so called victims and also the counter petitioner Ramesh and on the basis of the enquiry, he passed an order closing the complaint and sent the copies of the closure report to the petitioner as well as to the counsel appearing for the petitioner, but the petitioner refused to receive the closure report. He has produced the copies of the same along with typed set.

3. The learned counsel appearing for the petitioner would mainly contend that enquiry as directed by this Court was not conducted. 2/4

4. The learned Government Advocate (Criminal Side) appearing for the contemnor has produced photograph, wherein, the petitioner was shown to be enquired by the Assistant Commissioner of Police. But at the same time, it is not known how the police without registering FIR has conducted such an elaborate enquiry. But the fact remains that the Assistant Commissioner of Police conducted a detailed enquiry and on the basis of which, he proceeded to close the complaint. It is seen from the records that closure report is dated 29.11.2024.

5. Considering the above, this Contempt Petition stands closed. The petitioner is at liberty to file a private complaint, if so advised. 13.11.2025 NCC:Yes/No Index:Yes/No Internet:Yes/No csm 3/4
