ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the first respondent to provide adequate police protection to the life and limb of the petitioner and his family members by considering the petitioner's representation dated 05.12.2022 within the time limit, that may be stipulated by this Court.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the first respondent.

It is evident from the records that the petitioner has earlier filed a petition in Crl.O.P.(MD)No.19992 of 2022 seeking direction directing the Inspector of Police, Keelathooval Police Station and his police officials not to harass the petitioner in the guise of enquiry based on the second respondent's complaint and this Court vide order dated 23.11.2022 directed the Inspector of Police, Keelathooval Police Station 2/6

to issue summons, hold enquiry as per the guidelines issued by the Hon'ble Supreme Court in Lalitha Kumari's case and disposed off the petition.

The learned Government Advocate (Criminal Side) appearing for the first respondent would submit that in pursuance of the direction, FIR came to be registered in Crime No.163 of 2022 dated 08.12.2022 against three persons including the second respondent herein for the offences under Sections 294(b), 427, 448 and 506(2) IPC. He would further submit that the petitioner has again filed a petition seeking police protection.

5. Even according to the petitioner, there existed property dispute between the petitioner and the second respondent. Without approaching the competent civil Court, the petitioner has been attempting to get the reliefs through police, which cannot be entertained by this Court. However, since the complaint given by the petitioner is pending before the first respondent, the first respondent is directed to consider the representation of the petitioner dated 05.12.2022 and pass orders in 3/6

accordance with law within a period of three weeks from the date of receipt of a copy of this order.

6. With the above direction, this Criminal Original Petition stands disposed of.
