PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to direct R3 to not to harass the petitioner and her family members in the name of enquiry by considering the petitioner`s representation dt.7/11/2023 in accordance with law within the time stipulated by this Court.

ORDER

This petition has been filed seeking direction to the third respondnet to not to harass the petitioner and her family members in the name of enquiry by considering the petitioner's representation dt. 7/11/2023 in accordance with law within the time stipulated by this Court.

2.It is submitted that on the basis of the complaint given by one Megala enquiry has been undertaken. During the course of enquiry, the petitioner gave an undertaking that within a week he will settle the entire amount. Without responding the above said undertaking, this petition came to be filed. Since it is a money transaction, even though they hae given undertaking, they have to workout their remedy through appropriate civil proceedings. Therefore, by advising the parties, the complaint may be closed by the respondent police. 3.With the above said directions, this criminal original petition stands disposed of.

4.After disposing the case, the learned counsel for the petitioner requested to refer the matter to the Mediation Centre. Since he is ready to pay the balance amount, and seeking extension of time for the payment the matter is referred to the Mediation Centre. The petitioner and the fourth respondent are directed to appear before the Mediation Centre 22.12.2023. Let the centre send notice to the parties. 21.11.2023 NCC :
