ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 454,457 and 380 of IPC in Crime 1/3

No.1309 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that 12500 dhoties and sarees which were kept in the custody of the Treasury office, were found missing and the wooden door also broke opened,hence the case.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He would further submit that the petitioner is a field surveyor and he is no way connected with the alleged crime, hence he seeks anticipatory to the petitioner. 4.The learned Government Advocate(Crl.Side) appearing for the respondent submitted that dhoties and sarees which were kept in the custody of the Treasury office, were found missing and the wooden door also broke opened, hence she objected to grant anticipatory bail to the petitioner.

5. It is seen that the petitioner has been impleaded as an accused based on the confession given by the co-accused. As per the confession this petitioner only facilitated the other accused to commit the crime and help the take away the materials from the godown. Taking into consideration the facts and circumstances of the case and also taking into consideration the gravity of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3

6. Hence the petition stands dismissed.
