ORDER

This Criminal Original Petition has been filed to direct the respondents 2 and 3 to not to harass the petitioner under the guise of enquiry in a civil dispute by considering the petitioner's representation dated 16.11.2024.

2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor submitted that on the complaint given by the fourth respondent a case has been registered against the petitioner in Crime No.562 of 2024 for the offences under Sections 306 and 318(4) of BNS.

3. The petitioner who is a employee under Suresh had taken the cheque of his employer in a deceitful manner filled up the same and withdrawn a sum of Rs.18,00,000/- and thereafter absconded. Due to the sudden loss of money unable to meet out the other commitment the employer had lodged the complaint.

4. Since the petitioner is an accused it cannot be termed as harassment.

5. In view of the same, the Criminal Original Petition stands dismissed.
