Prayer : Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the learned District Munsif cum Judicial Magistrate, Orathanadu, to accept the surrender of the petitioner and recall the warrant and to consider on the same day for the Non Bailable Warrant issued against the petitioner on 23.11.2023 in S.T.C.No.94 of 2016 on the file of the District Munsif cum Judicial Magistrate, Orathanadu.

ORDER

This Criminal Original Petition has been filed to issue a direction to the District Munsif cum Judicial Magistrate, Orathanadu, to recall the Non Bailable Warrant issued against the petitioner on 23.11.2023 and consider the petitioner's surrender application on the same day of filing.

2. Even according to the learned counsel for the petitioner, the petitioner was aware of the proceedings and he had obtained anticipatory bail, which was cancelled by the learned District Munsif cum Judicial Magistrate, Orathanadu, since the petitioner did not appear on the date of hearing.

3. It is also seen that the case was split up against the petitioner. The trial has commenced against the other accused. Since the petitioner has been absconding since 23.11.2025, the direction sought for by the learned counsel for the petitioner cannot be granted.

4. With the above observation, this Criminal Original Petition is dismissed.
