PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to dispose the appeal in A1/5714/2022 dated 22.08.2022, filed by the petitioner under section 12 of the Patta Pass Book Act, based on the report filed by the 2nd respondent in his proceedings in Na.Ka.S1/8478/2022 dated 05.12.2022, pertains to the petitioner's property in town survey No.178/4, in ward D, Block-14, Sivakasi Town, Sivakasi Taluk, to an extent of 3,788 sq.ft (352 sq.meter) within a stipulated time frame fixed by this Court.

ORDER

The petitioner asserts title to the 3,788 sq.ft. in T.S.No.178/4. 2.Learned counsel for the petitioner refers to manual Town Survey Register reflecting the petitioner's name and to the report dated 05.12.2022 of the Tahsildar in such regard. He points out that an appeal was filed before the Revenue Divisional Officer for rectification of the Town Survey Land Register and that the same is pending.

3.Learned Government Advocate accepts notice on behalf of respondents 1 and 2. He submits that the pending appeal would be considered and disposed of within 12 weeks from the date of receipt of a copy of this order. 4.Given the nature of relief claimed, it is unnecessary to issue notice to the private respondents in this writ petition. Instead, this writ petition is disposed of by directing the first respondent to consider and dispose of the 2/4

petitioner's appeal within 12 weeks from the date of receipt of a copy of this order on merits after providing a reasonable opportunity to the petitioner and the private respondents herein. No costs.
