PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS Act. PRAYER :- For Anticipatory Bail in Crime No. 23 2024 on the file of the respondent police. 1/4

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 406, 420, 294(b) and 506(1) IPC, in Crime No.23 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and the husband of the defacto complainant were running finance business. Unfortunately, the husband of the defacto complainant died. The defacto complainant was asking for the share of the amount which has been invested by the husband of the defacto complainant, the same was not given. A compromise was attempted and the same also failed. 3.When the matter was came up for hearing on 28.11.2024, this Court considering the nature of transactions between the parties, referred the parties to Mediation. The Mediation report has been sent to this Court stating that there was no agreement reached.

4. Heard the learned counsel on either side and perused the material records of the case.

Taking into consideration the facts and circumstances of the case and considering the fact that the petitioner had the opportunity to settle the dispute with the defacto complainant, since the defacto complainant has now lost her husband and the petitioner could have produced all the relevant documents and the petitioner is not wiling to reach any settlement in this case, this Court finds the attitude and the conduct of the petitioner untenable. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
