ORDER
This Writ Petition is filed to issue a Writ of Centiorarified Mandamus, calling for the records relating to the impugned proceeding in Oo.Mu.No.4511/A3/2023, dated 06.10.2023 issued by the 2nd respondent and quash the same as illegal and consequently direct the respondents 1 and 2 to sanction and disburse Annual Increment due to writ petitioner from April 2012 without insisting the pass on TET examination forthwith
2. The issue raised in this writ petition is no longer res integra, as it has been decided by the Hon'ble Division Bench of this Court in 2/4
W.A(MD)No.558 of 2021 dated 22.06.2023. The Hon'ble Division Bench in a similar circumstances where the appointment of the teacher had been approved, had directed granting of annual increment by holding that such teachers are entitled for such annual increment and also issued directions to pay the same to the teacher and continue to pay the increments. Such direction was also directed to be completed within a period of eight weeks from the date of receipt of a copy of the order.
3. Applying the said law laid down by the Hon'ble Division Bench in the aforesaid judgment, this writ petition stands allowed and the respondents are directed to calculate the annual increment which the petitioner would be entitled to and disburse the same within a period of twelve weeks and thereafter continue to pay the regular annual increment as applicable to the petitioner. No costs. Consequently, connected miscellaneous petition stands closed.
