PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents 1 to 3 to conduct a survey and effect sub-division of the property measuring 32 cents being part of the larger extent of 66 cents in Survey No.338/1, Palamedu Village, Vadipatti Taluk, Madurai District in accordance with the registered Sale deed bearing Document No.2602 of 2005.

The petitioner asserts title over 12 cents of land in survey No. 338/1 under sale deed dated 03.07.2017 bearing document No. 1682/2017. By stating that the total extent in the said survey number was 66 cents and that the land was divided as 34 cents and 32 cents and 32 cents of land was separately conveyed under sale deed document No. 2602/2005, the petitioner submitted a representation dated 08.02.2023 seeking a survey and subdivision. On the basis that the said request was not acted upon, the present Writ Petition has been filed. 2/5
2. Learned Additional Government Pleader accepts notice on behalf of the respondents 1 to 3. Subject to the payment of requisite fees in such regard, he states that the petitioner's application would be acted upon after putting all the necessary parties on notice.
3. Patta No.1745 in respect of land in survey No.338/1 stands in the name of Francis Pandian, Rajendramohan, Karthigaiselvi and the petitioner. Therefore, it is necessary to put all these persons and the owners of the relevant adjacent lands on notice.
4. Subject to the observations, this Writ Petition is disposed of by directing the third respondent to conduct an inquiry on the basis of the petitioner's request and by taking into account the sale deed bearing Doc.No.2602/2005 dated 12.12.2005 after providing a reasonable opportunity to the petitioner, joint pattathars and adjacent landowners. Entire exercise shall be completed within a period of twelve (12) weeks from the date of payment of requisite fees by the petitioner.
5. In view of the direction that a reasonable opportunity should be 3/5
given to the private respondents, this Writ Petition is disposed of without notice to them. No costs.
