ORDER

This Criminal Original Petition filed to direct the respondents 1 and 2 to issue the Look Out Circular against the 4th respondent /first accused in Crime No.9/2023 on the file of the 2nd Respondent Police on the basis of her representation, dated 08.11.2023, within the time stipulated by this Court.

2.The grievance of the petitioner is that pending the investigation process, the four respondent has married some other girl on 10.12.2020 and he is taking steps to go abroad. On that ground, she filed this petition to issue a lookout circular.

3.The learned Additional Public Prosecutor submitted that the second respondent is taking every steps to complete the investigation in this case.

4.In the present case, there is no question of issuing a direction to the second respondent to issue lookout circular, since it can be issued by the second respondent/investigating officer depending upon the factual matrix and movement of the fourth respondent. Therefore, the prayer sought for by the petitioner is not maintainable. The fourth respondent can go abroad after getting proper permission in accordance with law.

5.Accordingly, this petition stands disposed of. 15.12.2023 NCC :
