ORDER : The Court made the following order :- The petitioner / accused apprehending arrest at the hands of the respondent police for the offences punishable under section 379 IPC in Crime No.871 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2. The case of the prosecution is that the petitioner herein accompanied with other two accused persons in his bike and near Kalavasal, they attacked the defacto complainant and stolen his cellphone. Hence, the complaint.

3. The leaned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case and hence, he seeks anticipatory bail.

4. The learned Government Advocate (Crl. Side) would submit that the petitioner herein is having one previous case in similar nature and hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Considering the serious nature of offence committed by the petitioner and also considering the fact the petitioner is having previous case in similar nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner.
