PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent No.3 to issue the patta in the name of the petitioner in respect of punja lands in Survey Nos.316/2, 316/3, 316/4 in Sangupatti Village, Thiruvangadam Taluk, Tenkasi District by considering the petitione'rs representation dated 27.12.2024 within the time stipulated by this Court.

ORDER
By asserting that the petitioner's father, S.M.Kalimuthu purchased the lands in S.Nos.316/2, 316/3 and 316/4 in Sangupatti Village under registered sale deed dated 03.05.1967, the petitioner had applied for cancellation of the patta issued in the name of one M.Seeni. On the last hearing date, I had directed petitioner to implead the said M.Seeni. At the hearing today, learned counsel for the petitioner states that the said M.Seeni has passed away and the petitioner is endeavouring to collect the particulars of the legal representatives of the deceased M.Seeni.
2.Learned Government Advocate has placed on record written instructions enclosing the revenue records relating to S.Nos.316/2, 316/3 and 316/4. He points out that the remark in relation to S.No.316/3 is Nilaviyal Vandi Pathai. He submits that an inquiry notice would be issued to the petitioner and to the legal heirs of the deceased M.Seeni and that a speaking order would be issued after providing a reasonable opportunity to all parties. 2/5
3.In view of the above submissions of learned Government Advocate, it is not necessary to implead the legal representatives of the deceased M.Seeni in this writ petition. Instead, the writ petition is disposed of by directing the Tahsildar to conduct an inquiry in relation to the petitioner's application by issuing notice to the petitioner and to the legal heirs of M.Seeni, provide a reasonable opportunity to them and thereafter, issue a speaking order within three months from the date of receipt of a copy of this order.
