PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, to withdraw the case in H.M.O.P.No. 330/2022 on the file of the Sub Judges Court, Kovilpatti and transfer the same to the Family Court, Ramanathapuram.

ORDER

The present transfer civil miscellaneous petition has been filed by the wife seeking to transfer H.M.O.P.No.330 of 2022 on the file of the Sub Court, Kovilpatti to Family Court, Ramanathapuram. 1/4

2. According to the learned counsel appearing for the petitioner/wife, the wife is in the family way and she is a permanent resident of Ramanathapuram. The learned counsel for the petitioner further submits that the petitioner/wife has filed H.M.O.P.No.132 of 2022 before the Family Court, Ramanathapuram to declare the marriage as null and void.

3. Considering the above said facts, H.M.O.P.No.330 of 2022 pending on the file of the Sub Court, Kovilpatti is hereby withdrawn and transferred to Family Court, Ramanathapuram to be tried along with H.M.O.P.No.132 of 2022.

4. With the above said direction, this Transfer Civil Miscellaneous Petition stands allowed. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
