ORDER
This writ petition has been filed seeking a direction to the first respondent to issue a fresh passport in respect of the petitioner's passport application No. MD1065562759725, by considering the petitioner's representations submitted through e-mail dated 13.09.2025 and 15.09.2025.
2. Heard Mr.A.Uthaya Kumar, learned counsel for the petitioner, Mr.B.Ponnupandi, learned Central Government Standing Counsel, who takes notice for the first respondent and Mr.S.Prakash, learned Government Advocate (crl. side), who takes notice for the second respondent.
3. According to the petitioner, she applied for a passport. However, it has been pending consideration. It is further submitted that the second respondent police had registered an FIR against the petitioner and his family members in Crime No. 461 of 2020 with regard to a property dispute. However, the said FIR has been closed as a mistake of fact.
4. The learned Government Advocate (Crl. Side) also confirms the same.

5. Considering the fact that the FIR has been closed as Mistake of Fact, there is no impediment for the first respondent to consider the application of petitioner. Accordingly, the first respondent is directed to act upon the passport application submitted by the petitioner and issue the passport in the petitioner's name within a period of two weeks from the date of receipt of a copy of this order, provided the petitioner satisfies all other statutory requirements.

This writ petition is allowed. No costs.
