PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the respondents 1 and 2 to produce the body or person of the petitioner's wife (Detenue), namely, Swetha, W/o. Hariharan, aged about 23 years before this Court and set her at liberty. 1/4

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) This Habeas Corpus Petition has been instituted to direct the respondents 1 and 2 to produce the body of person of the petitioner's wife / detenue, namely, Swetha, aged about 23 years.

2.Pursuant to the order of this Court dated 22.11.2023, the parties are present before this Court. We have examined the parties including the detenue independently and the detenue is clear and willing to join with the petitioner / Hariharan. She informed us that she has already married and living with him and he is meeting out her educational expenses to pursue B.Ed., course. She is a post graduate degree holder (M.Sc) and capable of deciding her life. 3.The husband of the detenue, namely, Hariharan / petitioner has also given an undertaking that he will take care of his wife and will not threaten the parents of the detenue / respondents 3 and 4 herein. 2/4

4.The husband of the detenue is working in Police Department as Grade-II Police Constable. Therefore, he is not expected to indulge in any such illegal activities and as per the Police Conduct Rules, he has to maintain good conduct both at home and in the society. Since the detenue is willing to join with her husband / petitioner, no further consideration is required and this Habeas Corpus Petition stands closed.
