ORDER

This Criminal Original Petition has been filed to quash the First Information Report registered in Crime No.85 of 2023 on the file of the first respondent Police Station.

2. The allegation in the FIR is that the petitioner rode the two wheeler in a rash and negligent manner with the victim seated as a pillion ridder; and that the petitioner lost control of the vehicle, as a result of which, the victim sustained injury and thus, committed the aforesaid offences.

3. Admittedly, the petitioner and the respondent Nos.2 and 3 have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo and the scanned copy of the compromise memo reads as follows:

The petitioner, namely, Parthasarathy.V.K (Aadhaar No.9821 8331 8578), second respondent, namely, Syed Noor Mohammed (Aadhaar No.3902 2998 6781), third respondent, namely, Syed Rizwan.S (Aadhaar No.2627 7500 7119) are present before this Court in person and identified by Mr.Arumugam, Special Sub Inspector of Police, TIW-Tirunelveli City. All the parties confirmed the compromise arrived at between them.

In view of the same and considering the nature of the offences and the relationship between the parties, this Court is of the view that no useful purpose would be served in keeping the impugned FIR pending investigation. Accordingly, the impugned FIR in Crime No.221 of 2023, dated 31.05.2023 is quashed and the Criminal Original Petition stands allowed. The petitioner shall pay a sum of Rs.5,000/- (Rupees Five Thousand only) as costs to the High Court Legal Services Authority attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
