O R D E R
This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the respondents to grant permission and adequate police protection for conducting Condemnation public meeting at near Veluchamypuram Bus Stand, Karur District scheduled on 29.12.2022 at evening at 5.00 p.m to 9.30 p.m by consiering the petitioner's representation dated on 26.12.2022.
2. Mr.A.Thiruvadi Kumar, learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the writ petitioner submitted that the the General Secretary of his party has announced condemnation of public meeting scheduled on 29.12.2022 at Karur and he has approached the respondents on 25.12.2022 and gave requisition letter seeking police protection for conducting Condemnation of public 2/6
meeting. Further, the petitioner gave a representation to the respondents on 26.12.2022. Since no order was passed, the writ petitioner has come before this Court for the above said relief.
4. The learned counsel for the petitioner further submitted that on the same day permission has been granted for some other public meetings due to political reasons, but the petitioner's earlier representations have not been considered favourably.
5. The learned Additional Public Prosecutor appearing for the respondents would submit that the respondents have received the representation of the writ petitioner and the same is pending for consideration.
6. I have considered the submission of the learned counsel appearing for the writ petitioner and the learned Additional Public Prosecutor appearing for the respondents.
7. It is brought to the notice of this Court that the Director General of Police, Tamil Nadu, Chennai had issued a circular memorandum in Rc. 3/6
007301/Genl.I (1)/2019, dated 09.04.2019, along with instructions to the Inspectors of Police throughout Tamil Nadu for consideration of applications seeking permission for conducting cultural programme. 8.Though it is for the respondents to consider the representation and grant relief in accordance with the abovesaid circular, I feel that it is appropriate to direct the respondents to act fairly on the representation of the petitioner and pass appropriate orders. Hence, the respondents shall consider the representation of the petitioner fairly in view of the detailed circular and guidelines issued by the Director General of Police and pass appropriate orders as expeditiously as possible.
9. With the above direction, this Writ Petition stands disposed of. No costs.
