This Civil Miscellaneous Petition has been filed to permit the petitioner herein to withdraw 50% of the deposit amount laid in M.C.O.P.No.52 of 2016 on the file of the learned Subordinate Judge, Devakottai, dated 29.07.2024.

2. Heard the learned counsel for the petitioner and the learned counsel for the first respondent.

3.The learned counsel for the first respondent has not raised any objection to allow this petition.

4. I have perused the affidavit filed in support of this application and being satisfied with the reasons stated in the affidavit and also taking 2/4

note of the no objection submitted by the learned counsel for the first respondent, this Court is inclined to allow this petition.

5. Accordingly, this Civil Miscellaneous Petition is allowed. The petitioner is permitted to withdraw 50% of the deposited amount with proportionate interest and costs by filing necessary application before the learned Subordinate Judge, Devakottai. 05.02.2026 VSD 3/4
