For Respondent : Mr.A.Thiruvadikumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1166 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A12, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b), 307, 341 and 302 IPC in Crime No.1166 of 2020 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 14.11.2020 at about 05.30 p.m., when the de-facto complainant's son, namely, Muruganantham and his friends were standing near St Mary's School, the accused persons came there and attacked the de-facto complainant's son with knife and aruval and thereby, he died on the spot. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been implicated in this case based on the confession statement of the co-accused. Hence, he seeks anticipatory bail.
4.The learned Additional Public Prosecutor would submit that the petitioner is having fifteen previous cases, out of which, three cases are murder cases and the petitioner was absconding for more https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.23338 of 2022 than two years. He would further submit that the investigation is still pending and the custodial interrogation of the petitioner is very much necessary in this case. Hence, he strongly opposed to grant anticipatory bail.
5.Considering the gravity and nature of the offence and also considering the facts that the petitioner is having fifteen previous cases and the investigation is still pending and the custodial interrogation of the petitioner is very much required in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
