ORDER

The petitioners seek to quash the impugned charge sheet in C.C.No.862/2025, on the file of learned Judicial Magistrate No.II, Nagercoil, which was filed for the offences under Sections 79, 296(b) and 351(2) of BNS, 2023 and Section 67 of Information Technology (Amendment) Act, 2008 and Section 4 Tamilnadu Prohibition of Harassment of Women Act, 2002.

2.The allegation against the petitioners is that the first petitioner had a love affair with the defacto complainant and threatened to upload the intimate pictures taken by him with the defacto complainant, since she refused to marry him and thus,committed the aforesaid offences.

3.The learned counsel for the petitioners and the learned counsel for the defacto complainant/the second respondent would submit that the parties have now entered into a compromise on the advise of the elders and well-wishers and both the parties have agreed that the impugned final report may be quashed.

5.The petitioners, namely, Jeya Prakash @ Jayaprakash (Aadhaar No.9778 3366 8120), Palani Malai(Aadhaar No.9566 0088 1113) and the second respondent, namely, Sree Sanchana (Aadhaar No. 4646 3487 1862) are present before this Court in person. They are identified by Mr.G.Ganesh Kumar, Police Constable, Cyber Crime Police Station, Kanyakumari District. All the parties confirmed the compromise arrived at between them.

6.Considering the nature of the offences and the fact that the parties have arrived at a compromise, this Court is of the view that no useful purpose would be served by keeping the impugned charge sheet pending trial. Accordingly, the impugned charge sheet in C.C.No.862 of 2025, on the file of the learned Judicial Magistrate No.II, Nagercoil, is quashed and the Criminal Original Petition stands allowed. 25.09.2025 NCC : Yes / No Index : Yes / No Internet : Yes cp 5/6
