ORDER : The Court made the following order :- The petitioner/A7, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 190, 103 and 351(3) of BNS, 2023, in Crime No.367 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity regarding the path way dispute, the petitioner and other accused attacked him with iron rod on his head and thereby, he caused grievous injuries on his head. Thereafter, he was taken to the hospital and the Doctor said he was died. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person. He further submitted that his name is used in the call and he has not committed 2/5

any offence as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner has received repeated calls from the other accused persons. In this regard, he has also produced CD files. He further submitted that there is specific overt act attributed against the petitioner. However, he opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration of the facts and circumstances of the case and also the fact that the petitioner has received repeated calls from the other accused persons and there is specific overt act attributed against the petitioner, 3/5

this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this criminal original petition is dismissed.
