ORDER

Mr.R.Sabarinathan, the petitioner herein, has filed the present Criminal Original Petition, through his counsel, Mr.T.M.Madasamy, having his office at No.79, Law Chambers, High Court Buildings, Madurai.

2. Mr.T.M.Madasamy reported to this Court on 31.01.2017 that Mr.R.Sabarinathan had revoked the vakalat. Accordingly, the memo filed by Mr.T.M.Madasamy, learned counsel, was taken on record and notice has been sent by this Court to Mr.R.Sabarinathan for his appearance. In fact, no notice need be sent to the petitioner, as it was the duty of the petitioner to engage another Advocate or to appear in person, after having revoked the vakalat given to Mr.T.M.Madasamy. Be that as it may, this Court perused the averments made in the affidavit and the relief sought for by the petitioner. In view of the law laid down by this Court in Sugesan Transport Pvt. Ltd. represented by its Director Rajendra Sheth No.7C, Second Canal Cross Road Gandhi Nagar Adyar, Chennai 600 020 vs.

The Assistant Commissioner of Police, J-2, Adyar Police Station, Adyar, Chennai 600 020 and another, reported in 2016 (2) CTC 286, the relief sought for by the petitioner cannot be granted. Hence, this Criminal Original Petition is dismissed with liberty to the petitioner to follow the mandates laid down in the above cited decision.
