The petitioner / Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 420 and 506(I) IPC in Crime No.164 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner herein and other accused have received a sum of Rs.3.50 Crores from the defacto complainant for selling of Iridium and subsequently, they have not given an Iridium nor return back the money and cheated the defato complainant. Hence the case.

3. The learned counsel for the petitioner would contend that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.

4. The learned Government Advocate (Crl. Side) would submit that it is a second anticipatory bail and the earlier petition filed by the petitioner was dismissed by this Court on 06.10.2023 and the amount involved in this case is huge and hence, the custodial interrogation of the petitioner is necessary and prays for dismissal of this petition.

5. Considering the serious nature of allegations made against the petitioner and that there is no change of circumstances after dismissal of the earlier petition, this Court is not inclined to grant anticipatory bail to the petitioner.
