ORDER
This Contempt Petition has been filed to punish the contemnors/respondents for wilfully disobeying and not complying with the order of this Court passed in W.P(MD) No.22490 of 2016, dated 23.11.2016. 2.Heard Mr.S.Chellapandian, learned counsel for the petitioner and Mr.D.Sadiq Raja, learned Additional Government Pleader for the respondents, who accepts notice on behalf of the Respondents. Therefore, no further notice is required to be issued to the Respondents. 3.The Hon'ble Writ Court, vide judgment and order dated 23.11.2016, had disposed of the aforesaid writ petition with the following directions:- "In the result, these writ petitions are disposed of, directing the second respondent in all the cases to consider the proposals sent by the fourth respondent schools, seeking to approve the appointment of the petitioners as Secondary Grade Teachers, in the light of the Division Bench Judgment in W.A.(MD).Nos.639 of 2015 etc., dated 2/7
17.06.2015 and to pass order of approval, within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petitions are closed." 4.The learned counsel for the petitioner submits that despite the judgment and order passed by this Court in W.P.(MD)No.22490 of 2016, dated 23.11.2016, the respondents have not complied with the directions of this Court. Thus, being no other alternative, the present Contempt Petition has been filed with the prayer that the respondents/contemnors have wilfully and deliberately flouted the order passed by this Court and are in contempt of the judgment and order of this Court dated 23.11.2016. Thus, they should be summoned and punished by exercising the powers under Sections 11 and 12 of the Contempt of Courts Act, 1971.
5.Today, when the matter is taken up, Mr.D.Sadiq Raja, learned Additional Government Pleader for the respondents has filed an affidavit of compliance of the respondents, dated 11.08.2025, annexing a copy of the order passed by the second respondent, dated 22.03.2024, in which it has been stated that the direction issued by the Writ Court in W.P.(MD) No.22490 of 2016, dated 23.11.2016 has been fully complied with and the entire monetary benefits have been paid to the petitioner and no amount is due to the petitioner.

6.In paragraph No.6 of the compliance affidavit, the aforesaid fact has been clearly stated, which is reproduced hereunder:- " 6.In obedience to the order made in W.P.(MD).No.22490 of 2016, dated 23.11.2016 the District Educational Officer (Elementary), Valliyur, vide his proceedings dated 22.03.2024, made in Na.Ka.No.2478/A5/2024 complied the order in letter and spirit thereby approved the appointment of the writ petitioner w.e.f. 05.12.2014. The monetary benefits were also been paid." 7.A copy of the compliance affidavit filed by the respondents, dated 11.08.2025 has been produced before this Court, which is now taken on record and a copy of the same has also been given to the learned counsel for the petitioner.
8.Thus, the learned Additional Government Pleader for the respondents submits that the respondents may be discharged from the present contempt proceedings, as the judgment and order of the Hon'ble Writ Court in W.P.(MD).No.22490 of 2016 dated 23.11.2016, has been fully complied with by the second respondent, vide order dated 22.03.2024 and the present Contempt Petition may also be disposed of, accordingly. 4/7
9.Mr.S.Chellapandian, learned counsel for the petitioner submits that he has received a copy of the compliance affidavit filed by the respondents, dated 11.08.2025, annexing a copy of the Order passed by the second respondent dated 22.03.2024 and has no objection, if the respondents are discharged from the contempt proceedings, as the judgment and order of the Writ Court dated 23.11.2016 has been complied with by the respondents, vide order dated 22.03.2024. He further submits that the entire monetary benefits due to the petitioner have already been paid to the petitioner and as of now, no amount is due to the petitioner.
10.Accordingly, in view of the submissions made by the learned counsels for the parties and after perusal of the judgment and order made in W.P.(MD).No. 22490 of 2016 dated 23.11.2016 and the compliance affidavit filed by the respondents, dated 11.08.2025, annexing a copy of the order passed by the second respondent, dated 22.03.2024 and also considering the fact that the entire monetary benefits have already been paid to the petitioner, this Court is satisfied that the direction issued by the Writ Court in W.P.(MD) No.22490 of 2016, dated 23.11.2016 has been fully complied with by the respondents and thus, no useful purpose would be served in continuing the present contempt proceedings against the respondents. Accordingly, the respondents are discharged from the present contempt proceedings. 5/7
11. In view of the above, the Contempt Petition is finally disposed of. No costs. The file is consigned to record.
