O R D E R

The petitioner has challenged Item No.1 of the tender-cum-auction notice dated 11.11.2024 issued by the second respondent.

2. By the impugned notice, the second respondent invited bids for allotment of three shops situated in Survey No.157, Old Town Survey No.7/3, New T.S. No.19, measuring an extent of 2 acres.

3. According to the petitioner, the said property belongs to the petitioner temple. It is submitted that the jurisdictional Civil Court has declared the petitioner temple as the owner of the property. Though an 2/6

appeal challenging the said decree is pending before this Court, this Court, by order dated 28.11.2024, restrained the respondents from proceeding with the tender process insofar as Item No.1 of the impugned notice is concerned. Pursuant to the said interim order, the auction has not been conducted.

4. In view of the above developments, no further cause survives for adjudication in the present writ petition.

5. Accordingly, the writ petition stands dismissed as infructuous. There shall be no order as to costs. Consequently, the connected miscellaneous petitions are closed.
