Mr.S.Ravi, Additional Public Prosecutor PETITION FOR BAIL Under Sec.483 of BNSS,2023. PRAYER :- For Bail in Crime No. 85 of 2024 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioner / Sole Accused, who was arrested and remanded to judicial custody on 05.04.2024 for the alleged offence under Sections 279 and 304-A of IPC @ 302 and 114 of IPC, in Crime No.85 of 2024, on the file of the respondent police, seeks bail.
2. When the matter was taken up for hearing today, the learned Additional Public Prosecutor appearing on behalf of the respondent police submitted that the petitioner had filed 3 earlier bail petitions before this Court in Crl.OP(MD).Nos.1905 1/3
of 2024, 10409 of 2024 and 14174 of 2024 and all these bail petitions were dismissed by this Court by orders dated 10.06.2024, 12.07.2024 and 09.09.2024. In fact in the last order, this Court had directed the Trial Court to expedite the hearing of S.C.No.166 of 2024 and complete the case within a period of 6 months.
3. The learned counsel for the petitioner submitted that he was not instructed about the 3 earlier bail petitions filed by the petitioner and therefore, the same was not mentioned in the present bail petition.
4. Taking into consideration the facts and circumstances of the case and considering the fact that 3 earlier bail petitions filed by the petitioner have been dismissed by this Court on merits and also considering the fact that the petitioner did not even instruct the counsel about the 3 earlier bail petitions filed before this Court and the same was dismissed, this Court finds that this petition lacks merits and hence, the same hereby is dismissed.
