PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents 1 to 4 to repair, re-erect and to maintain the survey marks boundary stones in northern side of Survey No.377/1 locate at Vaiyur Village, Peraiyur Taluk, Madurai District by conducting an enquiry with 6th respondent on the basis of petitioner`s representation dated 25.08.2025. This writ petition has been filed seeking issuance of a writ of mandamus, directing the respondents 1 to 4 to repair, re-erect and to maintain the survey marks boundary stones in northern side of Survey No.377/1 locate at Vaiyur Village, Peraiyur Taluk, Madurai District by conducting an enquiry with sixth respondent on the basis of petitioner's representation dated 25.08.2025.
2. Heard the learned counsel for the parties and perused the materials available on record.

3. The main allegation of the petitioner is that the survey stones laid after the survey were demolished by the sixth respondent. Aggrieved by the same, the petitioner submitted a representation dated 25.08.2025 before the official authorities. However, since no action has been taken, the present writ petition has been filed by the petitioner.

Learned counsel for the petitioner submitted that, as per Section 16 of the Tamil Nadu Survey and Boundaries Act, 1923, it is the duty of the Village Officer to prevent any destruction or removal of survey marks and, in the event of coming to know that any such mark has been destroyed or removed, he must inform the prescribed officer.
5. The learned Additional Government Pleader appearing for respondents 1 to 4 submitted that the fourth respondent will visit the subject land and report any destruction caused on the said land to the second respondent.
6. In view of the above, the fourth respondent shall visit the subject land and submit a report regarding any destruction or removal of survey stones by the sixth respondent. Based on the report submitted by the fourth respondent, the prescribed officer/Tahsildar shall examine the 3/6
matter and thereafter consider the petitioner's representation dated 25.08.2025 and pass appropriate orders on merits and in accordance with law. No costs.
