....Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondent herein to issue and transfer the patta in the petitioner name in respect of the property comprised in S.No.72/1B2 measuring an extent of 1.76.50 hectares punjai and also S.No. 73/1A1 measuring an extent of 0.03.00 hectares of punjai which is situated at Karungal Village, Gujiliyamparai Taluk, Dindigul District on the basis of petitioner representation dated 29.09.2023 within a time stipulated by this Court.

ORDER

The petitioner traces title from settlement deed dated 17.02.2023 in favour of the petitioner's vendor and subsequent sale deed dated 17.03.2023 in favour of the petitioner. After submitting a representation dated 29.09.2023, seeking patta, the present writ petition has been filed. 2.Learned Special Government Pleader submits that the settlor under settlement dated 17.02.2023 has initiated proceedings before the jurisdictional Revenue Divisional Officer for cancellation of such settlement. Learned counsel for the petitioner states that a partition suit has been filed by the family members of the settlor and that such partition suit is pending before the Sub Court, Vedasandur.

3.In these circumstances, no positive direction can be issued. Therefore, without making any observations on the merits, the respondent is directed to consider and dispose of the petitioner's representation dated 29.09.2023 on merits after providing a reasonable opportunity to the petitioner and all others with an interest in the relevant property. This exercise shall be completed within 12 weeks from the date of receipt of a copy of this order. 2/4
