ORDER
This Petition is filed challenging the impugned charge memo dated 08.08.2025 passed by the second respondent and and consequently to direct the second respondent to include the petitioner's name in the panel for promotion to the post of Sub Treasury Officer / Additional Sub Treasury Officer/Superintendent, without reference to the impugned charges.

When the matter was taken up for hearing, the learned Special Government Pleader submitted that the petitioner had submitted his explanation to the impugned charge memo and that an enquiry officer had also been appointed to enquire into the charges levelled against the petitioner. It is a settled proposition of law that in exercise of powers under Article 226 of the Constitution of India, this Court would not ordinarily interfere with the disciplinary proceedings at the stage of enquiry.
3. A perusal of the charges would prima facie indicate that this Court cannot exercise the power of judicial review to interfere with the said charge memo.
4. In view of the same, the writ petition stands disposed of with a direction to the respondents to conclude the disciplinary proceedings within a period of six months from the date of receipt of a copy of this order. The petitioner is also directed to co-operate with the enquiry proceedings. It is made clear that if the petitioner is exonerated, the 3/5
petitioner's name shall be included in the promotional panel and grant him promotion. No order as to costs. Consequently, connected Miscellaneous Petition is closed.
