ORDER : The Court made the following order :- The petitioner/A7, who was arrested and remanded to judicial custody on 18.07.2024 for the offences under Sections 294(b), 506(ii), 147, 148, 120(B) and 302 of IPC in P.R.C.No.12 of 2023 on the file of Learned Judicial Magistrate, Thiruvidaimaruthur, Thanjavur District in Crime No.387 of 2023 on the file of the respondent police, seeks bail.
2.The learned Additional Public Prosecutor submitted that when the matter was taken up on 24.01.2025, charges were not able to be framed since the other accused persons who are in custody were not produced before the court below. That apart, the learned Additional Public Prosecutor submitted that insofar as A2, A5 and A7 are concerned, they have been arrested in some other case and a memo to that effect has also been filed before this Court.
3.Considering the fact that the case is getting adjourned on one ground or the other and this petitioner had jumped bail and was able to be secured only after six months and there are totally 18 previous cases against the petitioner, this Court is not inclined to enlarge the petitioner on bail at this stage. 2/3
4.Accordingly, this criminal original petition is dismissed for the present. It is left open to the petitioner to revive his claim for bail after the charges are framed in this case.
