Respondents PRAYER: Writ Miscellaneous Petition filed under Article 226 of the Constitution of India, praying this Court to extend the time to pay the compensation amount to the fifth respondent as order of this Court passed in W.P(MD)No.5822 of 2021, dated 30.11.2023 by conforming the order of Debt Recovery Appellate Tribunal vide MA115/2015 which was partly allowed on 15.09.2020. Prayer in WP(MD).No.5822 of 2021 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a writ of Certiorarified Mandamus to call for the records of the impugned order of the 1st respondent in M.A.No.115/2015 dated 15-09-2020 and quash the same as illegal and consequently confirm the order of the 2nd respondent in A.O.R.No.1/2015 dated 21-07-2015 and the 3rd respondent in IA.No.826/2008 in R.P.No.352/2007 in D.R.C.No.Ex 52 and 53 dated 20-02-2015, and pass such further or other orders as this Honourable Court may deem fit and proper in the above facts and circumstances of the case and thus render justice. O R D E R

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The learned Counsel for the petitioner would submit that the petitioner is ready with the Bank demand draft to settle the amount as per the directions of this Court. Since the time granted by this Court expired, the respondent Bank is not receiving the demand draft given by the petitioner. Further even after the expiry of the time limit granted by this Court i.e, on 15.01.2024, no further action has been taken by the Bank against the petitioner based on the order of this Court. 2.That being the submission made, the time to settle the amount is extended by one week, from the date of receipt of a copy of this order, failing which, the Bank is entitled to proceed further as directed by the Debt Recovery Tribunal. It is made clear that no further application seeking extension of time or writ petition will be entertainable.
