Crime No. 260 of 2024 ... Respondent/Complainant For Petitioners : Mr.Lenin Kumar, Advocate.
For Respondent : Mr.A.Albert James, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS Act. PRAYER :- For Anticipatory Bail in Crime No.260 of 2024 on the file of the respondent police. 1/3
ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 6(4) of TNCS (RDCS) Order 1982 r/w. 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.260 of 2024, seeks anticipatory bail.
2. The case of the prosecution is that A1 and A2 were transporting 2,300 kgs of PDS rice in a lorry. The same was intercepted by the police team and they were arrested and the entire PDS rice was seized. They have shown fake bills as if the rice was procured from SSN Traders, Kerala. When the same was verified, it was found that the bills are fake. On further investigation, it was found that the petitioners (A4 an A5) are running a mill and a godown and they are the ones who are collecting the PDS rice and nearly 20 tons was seized from the mill and godown of the petitioners.
3. The learned Additional Public Prosecutor (Criminal Side), on instructions, submitted that there are no previous cases against the petitioners. However considering the huge quantity of PDS rice that has been seized from the mill and godown belonging to the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
