O R D E R

When the contempt petition came up for hearing on 10.01.2024, the learned Additional Government Pleader placed the communication made by the learned Additional District Judge, Pudukkottai dated 15.06.2022 to the District Collector Pudukkottai, wherein it was informed that the petitioner was functioning as Public Prosecutor from 30.05.2017 to 20.07.2017. This Court directed the amount to be paid to the petitioner based on the communication made by the learned Additional District Judge.

2. When the matter was taken up for hearing today, it was brought to the notice of this Court that the total amount of Rs.42,532/- was paid after deducting the TDS amount of Rs.4,725/-, out of the total amount of Rs.47,257/-.

3. The learned counsel for the petitioner submitted that, TDS amount has now been sent to the account of the Public Prosecutor and that credit has not been given to the petitioner. 2/4

4. In the considered view of this Court, when the TDS certificate is sought for, the same shall be issued in favour of the petitioner, since the petitioner has to take advantage of the TDS amount deducted while submitting IT returns while paying the remaining tax amount.

5. Accordingly, this Contempt Petition is disposed of in the above terms.
