ORDER : The Court made the following order :- The petitioners/accused, who arrayed as accused was arrested and remanded to judicial custody on 09.11.2023 for the offences punishable under Sections 328 IPC and 7(5) and 24(1) of Cigarette and other Tobacco Products Act in Crime No. 375 of 2023, on the file of the respondent police seek bail.

2. The case of the prosecution is that based on the secret information received, the respondent police conducted inspection on 09.11.2023 and at that time, the petitioners herein have illegally found in possession of 592.056 Kgs of Tobacco products worth about Rs.3,00,000/-. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and their names have been falsely implicated in this case. He would further submit that the petitioners are in judicial custody from 09.11.2023 and seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the contraband recovered from the petitioners is poisonous substances and hence, he strongly opposed to grant bail to the petitioners. 2/3

5. Considering the facts and circumstances of the case and also considering the serious nature of allegations made against the petitioners, this Court is not inclined to grant bail to the petitioners.
