O R D E R

This Civil Revision Petition has been filed against the order, 1/4

dated 10.03.2023 made in I.A.No.79 of 2024 in O.S.No.324 of 2012 on the file of the Additional Subordinate Court, Pudukkottai.

2. The above said suit was filed by the respondent / plaintiff for partition and the same was decreed ex parte on 10.02.2020. Thereafter, the respondents / defendants filed I.A.No.79 of 2021 seeking to restore the above said suit and the same was dismissed by the trial Court on 10.03.2023. Against which the present revision has been filed.

3. Today, when the matter was taken up for hearing, the learned counsel appearing for the petitioners submitted that the petitioners are ready and willing to pay the cost and prayed for allowing this revision petition.

4. In view of the said submission, the petitioners are directed to pay a sum of Rs.10,000/- (Rupees Ten Thousand) as cost to the respondent within a period of 15 days from the date of receipt of a copy of this order and file a cost memo before the concerned Court. On the memo filed by the revision petitioners, the trial Court may restore the 2/4

suit on file and dispose of the same, by following the by following this Court's circular in R.O.C.No.1599-A.2009/B5 dated 15.05.2009.

5. With the above direction, this Civil Revision Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
