PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 2 & 3 to conduct survey and demarcate the boundaries of the petitioner's land situated in S.No.100/10B, S.Sevalpatti Village, Singampunari Taluk, Sivagangai District as per his Challan dated 07.10.2024 within stipulated time framed by this Court.

This Writ Petition has been filed seeking for a direction to the respondents 2 & 3 to conduct survey and demarcate the boundaries of the petitioner's land situated in S.No.100/10B, S.Sevalpatti Village, Singampunari Taluk, Sivagangai District as per his Challan dated 07.10.2024.

2.The petitioner's grievance is that though he has made an application for survey and demarcation of the boundaries of the land on 07.10.2024, however, the same has been kept pending till date. Hence, the present Writ Petition.

3.Learned Additional Government Pleader for the official respondents would submit that a suit was filed by the respondents 5 & 6 for easementary rights. The said suit was dismissed for default. The representation was made after dismissal of the suit. However, it is found that the suit was restored on to the file of the trial Court at present. In the said circumstances, the learned Additional Government Pleader appearing for the respondents 1 to 3 argues that until the suit filed in the Civil Court culminates, the question of survey and demarcating the property does not arise.

4.Both parties are present and by considering their arguments, this Writ Petition is disposed of at the admission stage itself. 5.Since the grievance of the petitioner is with regard to the disposal of his representation dated 07.10.2024, the same shall be 3/6

disposed of by the second respondent, within a period of eight [8] weeks from the date of receipt of a copy of this order, after giving notice to all concerned.

6.With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
