ORDER
This criminal original petition is filed to direct the learned Judicial Magistrate, Theni, to accept the personal bond and two (2) common sureties pursuant to the bail orders passed in 1.Crl.M.P.No.2665 of 2025, 2. Crl.M.P.No. 2666 of 2025, 3. Crl.M.P.No.2668 of 2025, 4.Crl.M.P.No.2762 of 2025, 5.Crl.M.P.No.2764 of 2025 on the file of the learned Judicial Magistrate, Theni and 6. Crl.M.P.No.1885 of 2025 on the file of the learned Principal Sessions Judge, Theni.
2.It is the case of the petitioner is that he is accused in six different cases registered for the offences under Sections 305(a) and 331(4) of the BNS and in some cases, Sections 303(2) of BNS and Sections 309(4), 309(6) and 311 of the BNS; that in all the cases, the petitioner was granted bail by the learned Magistrate, on the condition to execute a bond for a sum of Rs.10,000/- with two sureties for the like sum; that though the bail petitions were allowed, he has not yet been released, as he is unable to furnish separate sureties for each of the six cases as insisted by the learned Judicial Magistrate; that it is impossible 2/5
for the petitioner to produce twelve sureties; and that a direction may be issued to the learned Judicial Magistrate to accept the personal bond and two common sureties in all six cases.
3.Heard the learned Additional Public Prosecutor appearing for the respondent police.
4.Admittedly, the petitioner was released on bail in all six cases. The insistence for separate sureties in each of the cases would be an onerous condition and it is reported that the petitioner is still languishing in jail as he is unable to comply with the said condition. Considering the above facts, this Court is inclined to direct the learned Judicial Magistrate, Theni, to accept separate personal bonds in all the cases from the petitioner and two common sureties for all the six cases.
