ORDER

This Civil Revision Petition is filed to allow the revision and set aside the fair and decreetal order dated 15.07.2025 made in IA No. 1/4

02/2024 in RLTOP No.61/2022 on the file of the III Additional Rent Court/III Additional District Munsif, Madurai Town.

2. The learned counsel appearing for the petitioner submitted that the petitioner was a tenant under the respondent. An application has been filed by the respondent herein to amend the name of the petitioner herein in the RLTOP as Ravichandran. Since, at the time of entering an agreement with the landlord, the tenant has signed the document as V.Ravi. The same was allowed by the Court below. The contention of the revision petitioner is that his original name was V Ravichandran. In the petition, his name was shown as V.Ravi and the signature was affixed as V Ravi and therefore, the revision petitioner disputed that the revision petitioner has not signed the document.

3. Per contra, the learned counsel appearing for the respondent submitted that even in the counter filed before the original authority, the counter was signed as V. Ravi.

4. Another contention which was raised by the revision petitioner is that the respondent is not the original landlord. However, learned 2/4

counsel appearing for the petitioner stated that in the evidence, it was recorded that the rent was handed over by the petitioner, to the respondent herein at the instance of one Pushpanaganathan and the respondent herein is not the original landlord.

5. The issue with regard to the identity of the petitioner and the signature has to be considered by the original authority at the time of trial. The trial court shall verify the authenticity of the signature and the document and also the fact that whether the respondent has entered into an agreement, by examining the witnesses who were examined by the petitioner as well as by the respondent. The trial shall be completed within a period of six months from the date of receipt of this order.

6. With the above direction, this Civil Revision Petition is disposed. No costs.
