PRAYER :- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned appointment notification issued by Respondent No.2 virtue of Na.Ka. No.52769/2023/vg; dated 26.08.2025 quash the same as illegal and consequently direct the Respondent No. 1 and 2 to issue afresh appointment notification by allot 50 percent vacancies to erstwhile Makkal Nala Paniyalar presently called to be as Thitta Orunginaipalar pursuant to the guidelines issued in G.O.No. 179 dated 27.11.2008 by issuance of proper appointment order to the petitioner.

ORDER

This writ petition is filed to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned appointment notification issued by the second respondent virtue of Na.Ka.No.52769/2023/vg; dated 26.08.2025 quash the same as illegal and consequently direct the respondents 1 and 2 to issue afresh appointment notification by allot 50 % vacancies to erstwhile Makkal 2/5

Nala Paniyalar presently called to be as Thitta Orunginaipalar pursuant to the guidelines issued in G.O.No. 179 dated 27.11.2008 by issuance of proper appointment order to the petitioner.

The petitioner is aged about 59 years and he has challenged the decision to issue the notification for appointment on the ground that pursuant to the notification for direct recruitment, the petitioner who had been appointed as Makkal Nala Paniyalargal, based on the Government order in G.O.M.S.No.496 dated 02.09.1989 would be left without any service. The petitioner had been engaged based on the beneficiary scheme envisaged by the Government and his request to treat him as direct recruitment as provided under the Municipal Service Rules cannot be entertained by this Court. The Consequential direction sought to issue a notification allotting 50% of the vacancies to the "erstwhile Makkal Nala Paniyalargal" presently called as "Thitta Orunginaipalar" also cannot be entertained, as the same falls outside the purview of the Tamil Nadu Municipal Service Rules.

3. In view of the above, this Court is of the view that the writ petition filed by the petitioner is not maintainable. Accordingly, this Writ Petition is dismissed. No Costs. Consequently, connected Miscellaneous Petitions are closed.
