The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 58 days in filing the appeal against the judgment and decree, dated 18.03.2025 in A.S.No.106 of 2023 on the file of the Sub Court, Musiri, confirming the judgment and decree, dated 13.02.2019 in O.S.No.110 of 2009 on the file of the District Munsif Court, Musiri. 2.Despite receipt of notice, the respondents 2, 3, 5 to 7 have not turned up.

3.Heard the learned counsel for the petitioners, learned counsel for the respondents 1 and 4 and also perused the records.

4.The learned counsel for the respondent would submit that they are leaving it to the discretion of the Court.

5.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the usual course.
