O R D E R
This petition has been filed by the petitioners to quash the charge sheet made in P.R.C.No.01 of 2024, on the file of the District Munsifcum-Judicial Magistrate Court, Peravurani, for the offences under Section 4(a) of the Explosive Substances Act, 1908 and Sections 147, 148, 427, 120(b) of IPC.
2. Based on the complaint given by the second respondent/defacto complainant, the police has registered FIR in Cr.No.42 of 2020, for the offences under Section 4(a) of the Explosive Substances Act, 1908 and Sections 147, 148, 427, 120(b) of IPC.
3. When the matter was taken up for hearing, the learned counsel on Page No. 2 of 5
both sides represented that during pendency of the case in P.R.C.No.01 of 2024, the matter has also been amicably settled between the parties as nobody was injured and to that effect, they have entered into a compromise and the same was filed before this Court.
4. Today, the defacto-complainant and all the accused/petitioners are present and the Court enquired about the terms of compromise. The defacto-complainant represented that they entered into a compromise and he has no objection to quash the FIR. A compromise memo, dated 30.01.2025 signed by the parties and their respective counsels, is also filed before this Court.
5. This Court has perused the terms of the compromise memo.
6. Considering the nature of the offences and considering the facts that nobody was injured and the parties have also entered into a compromise, it is appropriate to allow this petition.
7. Recording the said compromise memo, this petition is allowed and P.R.C.No.01 of 2024, on the file of the District Munsif-cum-Judicial Page No. 3 of 5
Magistrate Court, Peravurani, is quashed. The compromise memo, dated 30.01.2025 filed by the parties shall form part of this order.
