PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 2nd respondent to include petitioner name into joint patta No.3838 bearing S.F.No.147/2B, situate at Pazhaiyakannivadi Village, Dindigul West Taluk, Dindigul District, vide Doc. ORDER

By relying on sale deed dated 06.06.2023 relating to the land in S.No. 147/2B, the petitioner had applied for inclusion of his name in the joint patta. On the ground that such request has not been acted upon till date, the present writ petition has been filed.

2.Learned Government Advocate accepts notice on behalf of both the respondents. He submits that the petitioner's request would be considered and disposed of on merits within twelve weeks from the date of receipt of a copy of this order.

3.The petitioner has placed on record patta No.3838 in respect of S.No. 147/2B of an extent of 9.50 ares. The said patta stands in the names of Vellaichamy, Krishnasamy, Jeevaratnam and Chinna Kalai. Out of the 4 Pattadars, it appears that Vellaichamy and Jeevaratnam have conveyed a part of the land owned by them to the petitioner. In such circumstances, the petitioner has made out a case for consideration of his request after putting the joint pattadhars on notice.

4.Accordingly, this writ petition is disposed of by directing the second respondent to consider the petitioner's request and dispose of the same on merits after providing a reasonable opportunity to petitioner and the joint Pattadhars under patta No.3838. This excise shall be completed within 12 weeks from the date of receipt of a copy of this order.
