Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the fourth respondent in Na.Ka. No.731/2025/AA2 dated 30.06.2025 and quash the same and consequently, direct the third and fourth respondents to cancel the patta which was obtained by the private respondents by fraudulently for the lands situate in Vedasanthur Taluk, Padiyur Village in Natham Survey No.1910/16 to an extent of 0.0.55 cents and accordingly restore the patta in the name of petitioner's grandfather.

O R D E R

An order dated 30.06.2025 of the jurisdictional Tahsildar is impugned in this Writ Petition.

2. Learned Government Advocate accepts notice on behalf of respondents 1 to 5. He points out that a statutory appeal is available to 2/5

the petitioner.

3. The order impugned herein has been issued by the Tahsildar. By the said order, the petitioner's request for cancellation of the patta issued to the private respondents herein and for restoration of patta in the name of the petitioner's grandfather was rejected. While a patta mutation in the event of the death of the pattadar or transfer by the pattadar may be considered by the Tahsildar, a request for cancellation of patta is required to be considered by the Revenue Divisional Officer.

4. Given the nature of the petitioner's request, the appropriate remedy for the petitioner is to approach the Revenue Divisional Officer. If the petitioner lodges an appeal before the Revenue Divisional Officer within fifteen (15) days from the date of receipt of a copy of this order, the Revenue Divisional Officer shall receive and dispose of the same on merits after providing a reasonable opportunity to all parties concerned, including the private respondents herein.

5. This Writ Petition is disposed of on these terms. No costs. 3/5
