The petitioner, who is the second accused in Spl.S.C.No.63 of 2016, on the file of the Sessions Court, Special Court for the Exclusive Trial of POCSO Act Cases, Virudhunagar District, Srivilliputhur was convicted by the trial Court for the offence under Section 3(a) r/w Section 4 of Protection of Children from Sexual Offence Act, 2012 and was sentenced to undergo 10 years rigorous imprisonment with fine of 1/3

Rs.10,000/-, in default, he has to undergo one year simple imprisonment. As against the conviction and sentence, the petitioner has filed an appeal in Crl.A(MD) No.57 of 2023 and the same was admitted on 19.01.2023. The petitioner has also moved an application to suspend the sentence imposed as against him 2.Today(14.02.2025), when this Criminal Miscellaneous Petition is taken up for hearing, the learned counsel appearing for the petitioner submits that he is not pressing this petition.

3.The learned Government Advocate appearing for the respondent submits that this case has been registered for gang rape. The petitioner is the second accused. The age of the victim girl is 14 years.

4.Considering the nature and gravity of offence, this Court is not inclined to suspend the sentence imposed on the petitioner. 5.Accordingly, this Criminal Miscellaneous Petition is dismissed. sd/- 14/02/2025 / TRUE COPY / /02/2025 Sub-Assistant Registrar (C.S.
