ORDER

This Criminal Original Petition has been filed to set aside the order dated 22.02.2011, made in Crl.M.P.No.371 of 2011 in S.C.No.14 of 2008 on the file of the Sessions Court, Sivagangai.

2. Today, when the matter was taken up for consideration, the learned Additional Public Prosecutor submitted that the petitioner was convicted, by judgment dated 29.02.2016 in S.C.No.14 of 2008 and sentenced to undergo life imprisonment and to pay a fine of Rs.1,000/-, in default, to undergo two months rigorous imprisonment for the offence punishable under Section 302 of the Indian Penal Code. Aggrieved over the same, the petitioner filed an appeal before this Court in Crl.A.(MD)No.213 of 2016 and this Court, by judgment dated 18.11.2016, modified the conviction and sentence into one under Section 304(I) of the Indian Penal Code and the petitioner was sentenced to undergo 7 years rigorous imprisonment.

3. In view of submission so made, nothing survives for adjudication and hence, the Criminal Original Petition is

dismissed. Consequently, the connected miscellaneous petition is closed.
