RESPONDENTS 2&3/ACCUSED 2&3 PRAYER : Criminal Original Petition filed under Section 407 of Code of Criminal Procedure to withdraw the trial in C.C.No.82 of 2012 on the file of the Learned Judicial Magistrate.No.III, Nagercoil, and transfer the same to the file or any other Judicial Magistrate at Tirunelveli District having competent jurisdiction to try the offence.

(Prayer Amended as per order of this Court in Crl.MP(MD)No.1153/2018 in CRL OP(MD) No.18828 of 2013 dt.21.02.2018). ORDER : This Petition coming on for hearing on this day, upon perusing the petition and the requisition letter submitted by the Principal District Munsif-cum-Judicial Magistrate, Nanguneri in D.No.2403/2018 dated 26.12.2018 and the earlier order of this Court dated 21.03.2018 and in the presence of Mr.K.GUHAN, Advocate for the Petitioner and of Mr.T.LAJAPATHI ROY, Advocate for the 1st Respondent and of Mr.N.S.RAMAKRISHNA DASS, Advocate for the Second and Third Respondents, this Court made the following order:- This Petition has been listed today for extension of time for disposing the C.C.No.82 of 2012, pending on the file of the learned Principal District Munsif - Cum - Judicial Magistrate, Nanguneri.

2. This Court has already disposed of the Crl.O.P. by order dated 21.03.2018, directing the trial Court to dispose of C.C.No.82 of 2012, within a period of six months from the date of receipt of a copy of the order. Now, the trial Court seeks further more time for disposing the petition. Hence, the matter is listed today.

3. Considering the averments made by the Court below, this Court is inclined to extend time further.

4. Accordingly, the time for disposing the C.C.No.82 of 2012, is extended for a further period of four months from the date of receipt of a copy of this order.
