ORDER: The Court made the following order :- 1/4

The present petition is filed to cancel the bail. The learned Government Advocate submitted that the respondent/accused has three previous cases in which the accused was granted bail.

2. In the present case, the accused was arrested and remanded only for four days and was subsequently released on bail.

3. The contention of the prosecution for cancellation of bail is that when the accused was granted bail in earlier three cases, one of the conditions is that the accused should not commit the same offence subsequently. But the accused has allegedly committed the present offence, hence the accused is not entitled to bail and therefore seeks cancellation of bail.

4. This Court considered the contention of the prosecution. It is seen that the present bail was granted to the accused on 20.08.2025 and subsequently, no other offence has been committed by him. The accused might have committed three 2/4

offences earlier and after considering the same the Court has granted bail in the present case. When in the present case the accused has not committed subsequent offence, then the prosecution is not entitled to the prayer of cancellation of bail.

5. For the reasons stated above, this Criminal Original Petition stands dismissed.
