This Petition has been filed seeking orders to condone the delay of 80 days in filing the criminal appeal against the judgment of conviction and sentence in Spl.S.C.No.590 of 2024, dated 29.04.2025 on the file of the learned Principal Sessions Judge, Special Court for Exclusive Trial of Cases under POCSO Act, Tenkasi.

2.In response to the notice, the defacto complainant appeared in persons and would submit that they are having serious objections to condone the delay.

3.The learned Government Advocate (Criminal Side) appearing for the State would submit that the victim is aged 17 years at the time of incident and that they are having objections to condone the delay. 4.Heard both sides and also perused the records. 5.Considering the quantum of delay and the reasons assigned, the delay of 80 days in filing the Criminal Appeal, is condoned and accordingly, this petition is allowed. Registry is directed to number the appeal, if it is otherwise in order and list the matter in the usual course.
