Heard both sides.

2. The relief sought in respect of survey No.320/17, 320/18 in Erakudi Vadakkupatti Village. Survey No.320/18 is sarkar poramboke. The learned Special Government Pleader states that the encroachment in respect of the survey number had already been cleared.

3. It is not in dispute that survey No.320/17 is a water body. The petitioner alleges that the private respondents have committed encroachment in respect of the said water body.

4. The third respondent is directed to issue notice to the private respondents and other encroachers if any, conduct survey and if the encroachments are noticed, then by adhering to due process of law, the 2/4

3 W.P.(MD)NO.29371 OF 2024 encroachments shall be removed. The entire exercise will be completed within a period of three months from the date of receipt of a copy of this order.
